"LIMITED 100 DAY INSPECTION GUARANTEE"

  1. Introduction

    Your inspector is a home inspection generalist and is not acting as a licensed engineer, contractor or expert in any craft or trade. The scope of the inspection and report is a limited visual inspection of the general systems and components of the home to identify any system or component listed in the report which may be in need of immediate major repair. This Guarantee is not designed to provide reimbursement for normal maintenance, replace available insurance, areas noted faulty or needing attention in report, repair of tenant occupied damage after inspection, nor areas not accessible or able to be inspected. It applies only to the owner occupied one family resale house or condominium (not common areas).

  2. Elements Covered

    Your local Island Inspection Services performed an inspection of the readily accessible elements of the resale house described in the inspection report on the date noted. This guarantee is for the repair of elements specified below for a period of ninety (90) days from the inspection date if found to be in satisfactory condition.

    1. Central Heating: Includes the main house forced air heating system if reported by the Island Inspection inspector to be less than twelve (12) years old at the time of inspection.
    2. Central cooling: Includes the main house central air conditioning systems main housing assembly (not supply or return lines and vents) if reported by the island inspection inspector to be less than ten (10) years old at the time of inspection.
    3. Interior Electric: Includes the interior outlets, switches and light fixtures throughout the house, and main electric breaker box if reported to be less than fifteen (15) years old at the time of inspection.
    4. Interior Plumbing: Includes the interior faucets, tub enclosure, toilet tanks and bowls, drains under sinks, supply lines and angle stops throughout the house and the hot water heater if reported to be less than ten (10) years old at the time of inspection.
    5. Roofing OVER LIVING Areas: Includes sloped (greater than 2 on 12 to 6 on 12) roofing material and roof structure (does not include leaks) if reported by Island Inspection inspector to be less than ten (10) years old at the time of inspection. Does not include roofing over add on's such as porches, lanais, and separate carports.
    6. Foundation Walls: Includes exposed poured concrete and exposed block foundation walls to the extent that their load-bearing ability is affected. Water penetration or causes of water penetration are not covered.
    7. Kitchen Appliances: Includes built-in kitchen appliances reported by the Island Inspection inspector to be less than (8) eight years old at the time of inspection.
  3. Guarantee

    Island inspection will pay up to an aggregate maximum of $10,000 per inspection report for the repair of unexpected repair expense to covered elements subject to the following conditions:

    1. Any element or component of an element covered by this guarantee and inspected by the Island Inspection inspector and judged to be in satisfactory condition and so recorded in the inspection report will be eligible for repair under the Guarantee of repairs in excess of $75.00 up to a maximum of $1000 per element except that the following will not be eligible for repair under this guarantee:
      1. An element or component not covered in this guarantee
      2. An element not inspected due to condition of the structure or element at time of inspection;
      3. An element reported to be in unsatisfactory condition, noted as requiring further evaluation or noted as requiring future maintenance, repair or correction; or,
      4. Any element beyond age limits specified in the section entitled "Covered Elements".
    2. In no event will Island Inspection assume responsibility for repairs in the following circumstances:
      1. Conditions known by a seller or seller's agent prior to closing of escrow
      2. Conditions occurring after expiration date of guarantee
      3. Inspection Reports not fully paid for at the conclusion of the inspection
      4. Any repair work done by others not authorized by Island Inspections
      5. Damage done by occupants after inspection
    3. The Guarantee is provided for the exclusive benefit of the Island Inspection client. It may not be transferred or assigned to any other party without the written consent of Island Inspection.
    4. If, in the sole judgment of Island Inspection, it is not feasible to repair a condition using exact replacement parts, Island Inspection may substitute materials of a similar type and quality.
    5. Client is responsible for arranging access to the property and the opening up of any surfaces needed to complete a repair for covered items. Island Inspection assumes responsibility to restore surfaces to a rough finish but not for resurfacing and decorating after the repair work is completed.
  4. Limitations

    Other than as provided by this Guarantee, Island inspection assumes no responsibility to any party for:

    1. claims for repairs which may result from the conduct of the inspection
    2. the contents of the Inspection Report
    3. this Guarantee

    Island Inspection does not assume liability for bodily injury or property damage caused by any of the inspected elements. Island Inspection disclaims responsible for consequential or secondary damages or other condition resulting from the failure or malfunction of the components of the house. Island Inspection specifically disclaims any responsibility for (1) the adequacy of the capacity or the design of any element or component or its failure to comply with any local, state or national code, (2) buried elements, or (3) product recall or service issues. In addition, Island Inspection will not be responsible for costs necessitated by normal maintenance or for damages which result from neglect, or misuse, termites, or other insects, microorganisms, pets, pests, shifting or settling of land, subsidence, heavy rain storms, decay, condensation, floods, surface water, waves, tidal waves, nuclear or air contamination, war or any act of aggression and acts of God, or losses recoverable under homeowner insurance, manufacturer and or contractor warranties or service contracts or any other source.

  5. Procedure

    The Island Inspection client must notify the local Island Inspection office in writing during the term of this Guarantee and before any repair work is commenced. Island Inspection will forward a special Client Reporting Form to the client. The Island Inspection office will advise the client on the repair completion procedure. In cases where a condition makes the house uninhabitable, Island Inspection may authorize by telephone reasonable emergency repairs. Any repairs made prior to notification and authorization by Island Inspection will void this Guarantee with respect to the element or component so repaired. Island Inspection assumes no responsibility for a recurrence of a settled claimed condition once the repairs have been accepted.

  6. Arbitration

    In the event that a dispute arises between the client and Island Inspection as to Island Inspection's responsibility under this guarantee, such dispute will be presented to a recognized arbitration association at clients expense.
